Terms of Service

These terms govern your use of Perrywinkle AI ("Perrywinkle", "we", "us"). By creating an account or using the service you agree to them. If you use Perrywinkle on behalf of a business, you agree on that business's behalf.

The service

Perrywinkle designs, builds, and hosts websites for small businesses. Parts of the service use artificial intelligence to generate designs, text, and images from the information you provide.

Your account

You are responsible for your account and for keeping your sign-in credentials safe. You must give us accurate information about your business. You must be at least 18 years old to use the service.

Subscriptions and billing

Perrywinkle is a paid subscription billed through Stripe. Some features consume credits included in your plan or purchased separately. Prices and plan contents are shown at checkout. Subscriptions renew automatically until canceled. You can cancel at any time and your plan remains active through the end of the paid period. Fees already paid are not refunded except where the law requires it. If a payment is refunded anyway, the credits it paid for are removed from your account. If you dispute a payment with your bank, your plan ends at once and the credits on your account are removed. To reach us about a disputed payment, write to admin@perrywinkle.ai.

You can move to a bigger plan at any time. You are shown the amount before you confirm it: the difference in price for the rest of the period you have already paid for. It is charged at once, the extra credits are added at once, and your renewal date does not move.

Credits

Each plan brings a set number of credits every month. Credits from your plan are used first. Plan credits you have not used do not carry over: they end when the next month's credits arrive, and they end when your plan ends.

Credits you buy separately as a top-up do not expire while your account is open. Top-ups are sold only to accounts that have had a plan. Credits have no cash value, cannot be moved to another account, and are not refunded except where the law requires it.

When your credits run out, work that uses credits stops until more arrive. We email you when your balance runs low.

The pilot

If you join with a pilot invite code, your first two months on the T1 plan are free and bring 2,500 credits each month. No card is needed to start. An invite code works once, on the first plan an account subscribes to.

After the two free months the plan continues at its regular monthly price. If there is no card on your account, we email you seven days before the free months end and again in their last 24 hours. Without a card by then, Perrywinkle pauses its work until the first invoice is paid, and the plan ends if the invoice stays unpaid. Moving to a bigger plan during the pilot ends the free months on the day you move.

When a plan ends

A plan ends when you cancel it and the paid period runs out, when a payment fails and is not made good, or when a payment is disputed. Your account then becomes read-only. You can still sign in, read your work and restart your plan.

Hosting comes with a plan. A website that Perrywinkle hosts for you goes offline 72 hours after your plan ends. We email you first, and the 72 hours are counted from that email if it is sent after the plan ended. A website that has gone offline is kept for 30 days. After that the website, its files and its address are deleted, and they cannot be recovered. We email you at least seven days before the deletion.

If you restart your plan before the deletion, your website and its files are kept, and the website is back online once you publish it again.

A single page you publish at a Perrywinkle page address also goes offline 72 hours after your plan ends. The page and its address are kept, and the page is back online once you restart your plan and publish it again.

Your content

You own the content you provide and the website we generate for you. You give us the license we need to store, process, display, and host that content in order to provide the service. You are responsible for having the rights to any content you upload or import, including images taken from your existing website.

AI-generated content

AI-generated text and images can contain mistakes. Review your site before you publish it. You are responsible for the accuracy of claims your published site makes about your business.

Acceptable use

You may not use Perrywinkle to publish content that is unlawful, deceptive, infringing, or harmful, to send spam, or to interfere with the service or other customers. We may remove content or suspend accounts that violate this section.

Hosting and availability

We work to keep the service and your published site available, but we do not promise uninterrupted service. We may change or discontinue features. If we discontinue hosting, we will give you reasonable notice and a way to export your site.

Connected services

You can connect third-party services such as Google Business Profile and Google Search Console. Those services have their own terms, and you can disconnect them at any time. Our handling of connected data is described in the Privacy Policy.

Termination

You can stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms or create risk for us or for others. Sections that by their nature should survive termination do survive it.

Disclaimers

The service is provided as is, without warranties of any kind, express or implied. We do not warrant that your website will achieve any particular business result, search ranking, or amount of traffic.

Limitation of liability

To the fullest extent permitted by law, Perrywinkle is not liable for indirect, incidental, special, or consequential damages, or for lost profits or revenues. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules.

Changes to these terms

We may update these terms as the service evolves. We will post changes on this page and update the date at the top. If a change is significant, we will tell you by email or inside the product before it takes effect.
